A federal judge has struck down Health and Human Services Secretary Robert F. Kennedy Jr.'s sweeping changes to the nation's vaccine policy, halting his reductions to the recommended childhood immunization schedule and invalidating the reconstituted vaccine advisory panel he stacked with skeptics.

U.S. District Judge Brian E. Murphy granted a preliminary injunction Monday in favor of the American Academy of Pediatrics, finding that Kennedy's overhaul of the Advisory Committee on Immunization Practices violated federal law and that the CDC bypassed proper procedures when it altered the childhood immunization schedule without the committee's input.

Murphy ruled the changes were not only procedurally defective but also arbitrary and capricious, noting the agency abandoned its longstanding practice of seeking expert recommendations before modifying immunization guidelines.

Last summer, Kennedy removed all 17 sitting ACIP members, claiming the move was needed to restore trust in vaccine science. He then filled the seats with well-known vaccine critics and skeptics. That newly stacked panel subsequently voted to drop the birth dose recommendation for hepatitis B, delay the MMR vaccine combination, and remove the universal COVID-19 vaccine recommendation for children under six months old.

Murphy found serious credentialing problems with Kennedy's handpicked panel, noting that of the fifteen current members, only six appeared to have meaningful vaccine-related experience. He named six members specifically as appearing to lack any relevant expertise, and flagged three others, including vaccine critic Robert Malone, as falling short of the qualifications required under the committee's own charter.

HHS vowed to appeal, with spokesman Andrew Nixon dismissing the ruling as another attempt by a judge to obstruct the administration. Murphy declined to block an upcoming ACIP meeting outright but noted the blocked appointments effectively render any scheduled meeting void. HHS confirmed shortly after that the Wednesday and Thursday meeting has been postponed.
