 BREAKING Senator Mark Kelly is suing Secretary of Defense Pete Hegseth, the Department of Defense, the Navy Secretary, and the Navy.

2. The suit is in response to Hegseth issuing a formal letter of censure and initiating proceedings to retroactively reduce Kelly’s retired military rank and pension, which was all in response to Kelly saying that members of the U.S. military should refuse to follow unlawful orders.
3. Kelly argues these actions violate the First Amendment, the Speech or Debate Clause, due process, separation-of-powers principles, and federal military retirement law, and amount to executive punishment of a sitting legislator for protected oversight and political speech.
4. He is asking the court to declare the censure and grade-reduction proceedings unlawful, halt their enforcement, and preserve congressional independence from military discipline by the executive branch.
