Judge throws out indictment against actor Timothy Busfield

(NewsNation) — An indictment alleging child sexual abuse against actor-director Timothy Busfield has been thrown out after a New Mexico state judge faulted Bernalillo County prosecutors for giving false information to grand jurors early this year.
Busfield’s defense attorneys had argued that prosecutors prevented additional witnesses from testifying after grand jurors expressed interest in hearing from them. Prosecutors wrongly said subpoenas and additional time were needed, even though potential witnesses were immediately available to make an appearance, the actor’s legal team said.
On Friday, State District Judge Joseph Montano approved the defense motion to quash the indictment. He said prosecutors erred, in part because subpoenas are not necessary for “witnesses who willingly appear.”

“The actions by the State … had the practical effect of unilaterally withholding witnesses requested by the grand jurors,” Montano wrote in a six-page ruling. “The prosecuting attorney failed to act in a fair and impartial manner.”…..
